1. About GivingToHelp

GivingToHelp (givingtohelp.org) is an online fundraising platform for eligible New Zealand not-for-profit organisations ("GivingToHelp", "we", "us").

On GivingToHelp, approved organisations ("Organisations") can create campaign and event pages; individual supporters ("Fundraisers") can create fundraising pages in support of an Organisation’s cause; and anyone can donate or buy event tickets ("Donors").

GivingToHelp provides the technology only. We do not receive or hold donations: payments go to our payment partner, which pays them to the Organisation.

By using GivingToHelp you agree to these Terms, including the Content Rules and Code of Conduct below, and to our Privacy Policy.

2. Who can use GivingToHelp

You must be 18 or older to create an account, fundraising page or event. People under 18 may donate or buy tickets only with a parent's or guardian's permission. You may act for an Organisation only if it has authorised you to do so.

3. Organisations

Organisations must be registered charities, incorporated societies, trusts or other not-for-profit organisations, and must be approved by us before their pages go live. We may ask for registration details, governing documents and contact details for the people managing the account. Our payment processing partner will also verify each Organisation before paying out funds. We may refuse or remove an Organisation, and will give reasons where we can.

4. Fundraising and event pages

• Every page must say clearly what the money raised will be used for.
• Funds must be used only for that purpose. If the purpose changes, update the page straight away and tell us.
• A Fundraiser's page raises money for a named Organisation; all donations go to that Organisation, not to the Fundraiser.
• You must have a person's consent before publishing their name, photo or personal details, and a parent's or guardian's consent for anyone under 18.
• We review pages before they become publicly searchable, and may edit or remove content that breaches these Terms.
• Keep Donors informed with updates about how the money is being used.

5. Fees

GivingToHelp does not charge a platform fee. Payment processing fees may apply and are determined by our payment processing partner individually for each Organisation during its onboarding process.

The applicable processing fees, including any transaction charges or other fees, will be communicated to the Organisation by the payment processing partner during onboarding. These fees may vary between Organisations and may depend on the payment methods and processing arrangements applicable to the Organisation.

Any applicable processing fees are deducted from payments before the remaining funds are paid out to the Organisation, in accordance with the payment partner's applicable terms and payout arrangements.

Organisations are responsible for reviewing and understanding the fees applicable to their accounts before accepting the payment partner's processing arrangements.

6. Payments

Donations and ticket payments can be made by credit or debit card, bank transfer, or eWallet. All payments are processed by our payment processing partner under its own terms and privacy policy, and the payment partner carries out its own identity and anti-money-laundering checks that the law requires. The minimum donation is $1.

7. Recurring donations

You can choose to donate the same amount automatically at a regular interval. Your payment method will be charged on the dates and at the frequency you choose until you cancel. You can change or cancel a recurring donation at any time from your account or by emailing info@givingtohelp.org; cancellation applies to payments not yet made. If a payment fails, we may notify you and stop the recurring donation. If the page or Organisation you support closes, we will stop the recurring donation and let you know.

8. Payouts to Organisations

Our payment processing partner pays donations and ticket sales, less its processing fee, to the Organisation's verified bank account on its payout schedule. GivingToHelp does not hold or pay out funds. Payouts may be delayed while the payment processing partner completes its checks or while a complaint or suspected fraud is investigated.

9. Events and tickets

Organisations selling tickets are responsible for running the event, describing it accurately, and offering refunds if it is cancelled or materially changed. Ticket prices must include GST where it applies. Buying a ticket is not a donation and is not eligible for a donation tax credit.

10. Refunds

Donations go to the Organisation and are generally not refundable once made. Contact us at info@givingtohelp.org if a payment was unauthorised or made in error, or if you think a page is fraudulent or misleading; we will work with the payment processing partner and the Organisation to arrange a refund where appropriate. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

11. Receipts

Every Donor receives an email confirmation of each payment. GivingToHelp may issue donation receipts on behalf of eligible Organisations where the Organisation is approved by Inland Revenue as a donee organisation and the donation qualifies for a donation tax credit. Receipt eligibility depends on the applicable tax rules. GivingToHelp does not provide tax advice.

12. Your account

You must give us accurate information and keep it up to date. Keep your login details private, and tell us straight away at info@givingtohelp.org if you think your account has been misused. We may lock an account temporarily to protect you or the platform.

13. Suspension and closure

We may suspend or remove a page or account if you breach these Terms, if we receive a serious complaint, if our payment processing partner cannot verify an Organisation, or if the law requires it. Where practicable, we will tell you why and give you a chance to respond. You can close your account at any time by emailing info@givingtohelp.org.

14. Reporting harmful or unlawful content

If you think content on GivingToHelp is harmful, unlawful, misleading or breaches someone's rights, email info@givingtohelp.org. For complaints under the Harmful Digital Communications Act 2015, we follow the process in section 24 of that Act, including passing the complaint to the author within 48 hours.

15. Liability

We work to keep GivingToHelp running but cannot guarantee it will always be available or error-free. We do not control how Organisations use the funds they receive. To the extent the law allows, we are not liable for indirect or consequential loss. Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

16. Your responsibility

You are responsible for any loss we suffer because of content you upload or your breach of these Terms, to the extent that loss is caused by you.

17. Changes to these Terms

We will give at least 30 days' notice of material changes by email and on the website. If you don't agree with a change, you can close your account before it takes effect.

18. Questions and complaints

Please contact us at info@givingtohelp.org or 18 Hadfield Avenue, Waterview, Auckland 1026. We aim to respond within 5 working days and resolve complaints within 20 working days. Complaints about a payment can also be raised with our payment processing partner under its complaints process.

19. General

New Zealand law governs these Terms, and New Zealand courts have jurisdiction. If any part of these Terms is invalid, the rest still applies.

20. Content Rules

You must not post anything on GivingToHelp that:

• is false, misleading or out of date, including about who you are, who you represent, or how donations will be used;
• infringes anyone's copyright, trade mark or other rights;
• uses someone's name, image or personal details without consent (or a parent's or guardian's consent for anyone under 18);
• is defamatory, abusive, sexual, violent, discriminatory or otherwise offensive;
• encourages or involves illegal activity;
• takes advantage of people because of their circumstances;
• runs a raffle, lottery, competition or other gambling;
• sells goods or services, other than event tickets sold through our events feature;
• offers donors a return, investment or material benefit in exchange for a donation;
• sends spam, or interferes with the platform's operation or security.

We review pages before they become publicly searchable and may remove or edit content, or close a page, if it breaches these rules. GivingToHelp does not endorse any page, and Donors decide for themselves whether to give.

21. Code of Conduct

Everyone using GivingToHelp agrees to:

• be honest in everything they post or tell us;
• treat other users and our team with respect;
• respond promptly to our questions and to reasonable questions from Donors;
• tell us at info@givingtohelp.org if they doubt that a page, cause or Organisation is genuine.

Fundraisers and Organisations also agree to:

• use funds only for the purpose stated on the page;
• keep the page up to date and tell Donors and us if the purpose changes or can't go ahead;
• comply with all New Zealand laws that apply to their fundraising and their use of funds, including tax and reporting obligations.

1. What we collect

Donors and ticket buyers: your name, email address, street address, birth date, Google/Facebook sign-in data and the amount and frequency of your donation or ticket purchase, any message you leave, and the details needed to issue your receipt.

Fundraisers: your name, email address, phone number, profile photo, and the content you put on your page.

Organisations: the organisation's name, legal and charity registration details, donee status with Inland Revenue, bank details, bank statement and electronic signature and the name and contact details of the people who manage the account.

Payments: all payments, including recurring donations, are processed by our secure payment partner. We do not receive or store full card numbers or bank details. Our payment partner tells us whether a payment succeeded, its amount, date and payment method type.

Automatically: your IP address, device and browser type, pages visited, and the date and time of visits, collected through cookies and similar technologies (see section 7).

We collect only what we need for the purposes in section 3. If you don't provide it, we may not be able to process your donation, publish your page or issue a receipt.

2. Information we receive from other people

Sometimes we receive information about you from someone other than you:

• a Fundraiser or Organisation may name or describe you as a Beneficiary on a page;
• an Organisation may add you as a representative on its account;
• Our payment partner sends us payment confirmations and, where relevant, the outcome of its identity and anti-money-laundering checks on an Organisation.

We use this information only for the purposes in section 3. As Information Privacy Principle 3A requires, we take reasonable steps to let you know when we collect your information this way, unless an exception applies. Fundraisers and Organisations must have a Beneficiary's consent before publishing their personal information.

3. How we use your information

• to process donations, recurring donations and ticket purchases, and send confirmations and receipts;
• to publish fundraising and event pages;
• to approve Organisations and check that pages are genuine;
• to prevent fraud and misuse of the platform;
• to answer questions and resolve complaints;
• to improve the website and understand how it is used;
• to send you news and appeals, only if you have opted in. Every marketing email includes an unsubscribe link, as the Unsolicited Electronic Messages Act 2007 requires.

4. What is shown publicly

Fundraising pages may display information about donations, including the donor's name, donation amount and any message submitted with the donation, according to the options available at the time of giving. Please do not include sensitive personal information in a public message.

Information provided to GivingToHelp for payment processing, administration, security or legal purposes may be handled separately from information displayed publicly. The Organisation receiving your donation may also receive relevant transaction information.

5. Who we share your information with

• The Organisation you support or whose event you attend, so it can thank you, keep records, manage event ticketing and attendee admission (including attendee names, email addresses and phone numbers), and meet its legal obligations.
• Our payment processing partner, to process payments and pay out funds. They carry out the identity and anti-money-laundering checks required by the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, under their own privacy policy.
• Service providers that host and run our website for us, who may use your information only to provide that service.
• Authorities, where the law requires or allows it, for example to prevent fraud or comply with a court order.
• A successor, if GivingToHelp is restructured or transferred, under the same privacy protections.

We do not sell personal information, and we do not share it with advertisers.

6. Where information is stored and how we protect it

We use third-party technology providers to host and operate GivingToHelp and to help protect the personal information we handle. These providers may store or process information in New Zealand or overseas, depending on the services used and their configurations.

We take reasonable steps to protect personal information against loss, unauthorised access, use, modification or disclosure. Our safeguards may include encrypted connections, access controls and other security measures appropriate to the information and the risks involved.

No method of storage or transmission is completely secure. If a privacy breach is notifiable under the Privacy Act 2020, we will notify the Privacy Commissioner and affected individuals as soon as practicable, as required by law.

7. Cookies

We use essential cookies to keep you signed in and keep the site secure; the site doesn't work without them. With your agreement, we also use analytics cookies to understand how the site is used. You can decline analytics cookies and still use the site. Embedded content, such as videos, may set its own cookies, which are governed by that provider's policy.

8. How long we keep information

• Donation and receipt records: 7 years, to meet tax record-keeping requirements.
• Accounts and fundraising pages: while your account is open, and 12 months after it closes.
• Marketing preferences: until you unsubscribe.

After that, we securely delete or anonymise the information.

9. Your rights

You can request access to personal information we hold about you and ask us to correct information that you believe is inaccurate. We will respond to your request within the timeframe required by the Privacy Act 2020. If an extension is permitted and necessary, we will notify you as required by law.

You may also request account closure or ask us to stop sending you marketing communications. We may need to retain certain information where required or permitted by law, or where necessary to resolve disputes, maintain required records or protect the platform.

10. Children

You must be 18 or older to create an account, fundraising page or event. People under 18 may donate or buy tickets only with a parent's or guardian's permission. Fundraisers and Organisations need a parent's or guardian's consent before featuring anyone under 18.

11. Changes to this policy

We will post any update on this page with a new "last updated" date, and email account holders about significant changes.

12. Contact and complaints

Please send privacy questions, requests and complaints to our Privacy Officer at info@givingtohelp.org or 18 Hadfield Avenue, Waterview, Auckland 1026, New Zealand.

If you're not satisfied with our response, you can complain to the Office of the Privacy Commissioner at privacy.org.nz or on 0800 803 909.
